WHEELIE KIDS – TERMS AND CONDITIONS OF HIRE

PLEASE READ CAREFULLY — THIS DOCUMENT AFFECTS YOUR LEGAL RIGHTS. By hiring Wheelie Kids ride-on vehicles, tracks, or Wheelie Kids Wheelchairs, you acknowledge that you understand and agree to all Terms & Conditions outlined below. These Terms form the basis upon which Wheelie Kids (Jump Easy) agrees to supply recreational hire equipment. The following Terms & Conditions must be accepted by the Hirer prior to Wheelie Kids making any goods or services available.

1. Definitions and Interpretation

“Goods” Ride‑on cars, tracks, cones, barriers, accessories, wheelchairs, wheelchair accessories, batteries, chargers, and any other equipment supplied by Wheelie Kids.

“GST” Goods and Services Tax under the A New Tax System (Goods and Services Tax) Act 1999.

“Wheelie Kids” Wheelie Kids, operated by Jump Easy Inflatables Pty Ltd ABN 92 634 101 367.

“Hire Period” The confirmed booking period stated in your booking confirmation email. Wheelie Kids staff may require access up to 1 hour prior for safety checks, installation, and briefing.

“Hirer” The person, company, or organisation hiring Wheelie Kids equipment.

“Owner” Jump Easy Inflatables Pty Ltd, including its employees and agents.

“Site” The location where the hired goods will be used, as specified by the Hirer.

“Terms” These Terms & Conditions of Hire, including annexed Safety Rules and the Risk Warning & Liability Waiver.

2. Basis of Contract

2.1 These Terms are the only Terms under which Wheelie Kids will provide goods or services unless otherwise agreed in writing.

2.2 Acceptance occurs electronically when the Hirer ticks the acceptance box during the booking process.

2.3 These Terms apply exclusively to every hire contract and cannot be varied without written consent.

2.4 If Wheelie Kids accepts a booking, goods will be supplied for the Hire Period at the nominated Site, subject to these Terms.

2.5 All goods remain the property of the Owner at all times.

3. Hire Charges & Variations

3.1 Standard hire pricing assumes:

• Delivery, setup, and collection during normal working hours • Suitable access and level ground • Adequate space for the track or wheelchair use area • Goods returned clean and in good condition

3.2 Variations may incur additional charges.

3.3 All prices include GST.

3.4 No deposit is required. Bookings must be paid in full prior to delivery unless otherwise approved.

4. Compliance with Australian Standards

4.1 All activities undertaken shall be performed in compliance with all relevant Australian Standards for the industry and activity to be undertaken.

4.2 This includes, but is not limited to:

• AS/NZS 3695 series – Wheelchairs • AS/NZS ISO 8124 series – Ride‑on toys • AS/NZS 60335.1 – Electrical equipment safety • AS 3533 series – Amusement devices (where applicable) • AS/NZS 4801 – Occupational health & safety • AS ISO 31000 – Risk management • AS/NZS 3760 – Electrical test & tag requirements

5. Equipment Compliance

5.1 All operational equipment shall meet the relevant Australian Standard applicable to its category, design, and intended use.

5.2 Wheelie Kids ensures all wheelchairs, ride‑on vehicles, chargers, batteries, barriers, and accessories meet or exceed the applicable Australian Standard.

6. Invoicing, Payment & Bonds

6.1 Payment requirements:

• Full payment prior to delivery • Corporate accounts: 30‑day terms (subject to approval)

6.2 EFT payments must be receipted via email.

6.3 A security bond may be required. The Hirer authorises Wheelie Kids to pre‑authorise or debit their card for damage, cleaning, or extended hire fees.

6.4 The Hirer agrees to pay all costs incurred due to breach of these Terms.

7. Cancellations & Variations

7.1 If Wheelie Kids cannot supply goods due to circumstances beyond control, Wheelie Kids may modify or cancel the booking.

7.2 Hirer cancellations forfeit any paid hire fees according to the schedule below.

7.3 By booking equipment, the Hirer removes its availability to others. Weather‑related cancellations for outdoor venues remain subject to standard cancellation fees.

7.4 Cancellation fees:

• Less than 7 days: full hire fee payable • More than 7 days: 50% of hire fee payable

7.5 Weather Policy

Weather does not void this contract. If the Hirer chooses not to proceed due to weather, standard cancellation fees apply. Wheelie Kids will attempt safe installation where possible; however, unsuitable outdoor venues do not constitute grounds for cancellation or refund.

8. Delivery & Collection

8.1 Goods are delivered clean but not sterile. Hirer must ensure suitability for use.

8.2 Hirer must provide safe access for delivery, setup, inspection, and collection.

8.3 Goods must be ready for collection at the end of the Hire Period. Additional charges apply if goods are not clean, dry, or properly packed.

8.4 Cleaning Fee Schedule

Cleaning fees start at $40 and increase depending on soilage, mud, food, drink, glitter, sand, face‑paint or other contaminants.

9. Responsibility of Hirer

9.1 The Hirer bears all risk during the Hire Period.

9.2 The Hirer is responsible for:

• Safe operation of ride‑on vehicles • Safe operation of wheelchairs • Supervising children at all times • Ensuring goods remain at the nominated Site • Protecting goods from damage, theft, weather, or misuse • Complying with all laws and safety instructions • Preventing operation beyond rated capacity • Immediately reporting unsafe equipment or faults

9.3 Mandatory Supervision

A responsible adult (18+) must supervise all equipment at all times. Lack of supervision voids liability protections and may result in damage fees.

9.4 Site Suitability Requirements

The Site must be flat, level, free of slopes, loose gravel, hazards, overhead obstructions, and must meet the minimum space requirements listed on the Wheelie Kids website. Failure to meet these conditions may result in additional charges or inability to install equipment.

9.5 Goods Must Not Be Moved

Goods must not be moved from the nominated Site unless in an emergency and Wheelie Kids is notified immediately.

10. Safe Operation Rules & Compliance

Ride‑On Cars & Track Equipment

10.1 Hirer elects to self‑supervise and must follow all safety instructions provided.

10.2 Hirer must read and agree to the Risk Warning & Liability Waiver.

10.3 A signed waiver must be provided before setup can proceed. Failure to provide the waiver will result in the booking being unable to proceed and the full hire fee being charged.

10.4 Hirer acknowledges risks associated with ride‑on vehicles and accepts full responsibility for all users during the Hire Period.

Wheelchair Hire Safety

10.5 Hirer must complete a pre‑hire inspection checklist before each hire, including:

• Frame integrity • Tyres • Brakes • Seat, armrests, footrests • Cleanliness • No sharp edges • Accessories in good condition

10.6 Any defect must be reported immediately and the wheelchair must be tagged out.

10.7 Hirer acknowledges risks associated with wheelchair use and accepts responsibility for safe operation.

10.8 Wheelchair Capacity Limits

Wheelchairs must not be used by riders exceeding the stated weight or height limits.

10.9 No Repairs by Hirer

The Hirer must not attempt repairs, adjustments, or modifications to any equipment.

11. Insurance & Indemnity

11.1 Hirer indemnifies Wheelie Kids for all loss or damage except defects arising from normal use.

11.2 Hirer must maintain appropriate insurance for:

• Theft or loss • Damage • Liability and injury claims

Failure to do so may expose the Hirer to personal liability.

12. Breakdown or Defect

12.1 Hirer must inspect goods on delivery and report issues immediately.

12.2 Defects from normal use may be repaired or replaced at Wheelie Kids’ discretion.

12.3 If repair or replacement is not possible, proportional credit may be issued.

12.4 No relief from hire charges is provided for issues outside Wheelie Kids’ control, including weather or unsuitable site conditions.

12.5 Hirer must not attempt repairs without approval.

13. Default & Termination

13.1 Wheelie Kids may terminate the hire if the Hirer breaches Terms or becomes insolvent.

13.2 Upon termination, goods must be immediately available for collection. Wheelie Kids may enter premises to retrieve goods.

14. Limitations & Exclusions

14.1 All warranties except those required by law are excluded.

14.2 Wheelie Kids’ liability is limited to repair or replacement of defective goods.

14.3 Wheelie Kids is not liable for delays, cancellations, or variations beyond its control.

14.4 Nothing in these Terms excludes rights under Australian Consumer Law.

15. Jurisdiction & Severability

15.1 South Australian law applies.

15.2 Invalid Terms may be severed without affecting remaining Terms.

16. Release & Indemnity

16.1 Hirer releases and indemnifies Wheelie Kids (Jump Easy) from all claims arising from use of the equipment, in accordance with the signed Risk Warning & Waiver.

16.2 Damage Fee Schedule

Damage fees apply for tears, punctures, water damage, electrical damage, missing parts, bent frames, broken accessories, or contamination requiring deep cleaning. Fees are charged at repair or replacement cost plus lost hire income.
